Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of Mad Monkey’s website, store, wholesale program, custom-production services, communications, and related services operated by Mr. Buff Inc.

1. Accounts and Accurate Information

You are responsible for providing accurate information and safeguarding your account credentials. You are responsible for activity through your account except where prohibited by law.

2. Orders and Availability

Orders are subject to acceptance, availability, pricing verification, fraud screening, and payment authorization. We may cancel or limit an order when reasonably necessary because of inventory errors, pricing mistakes, suspected fraud, legal restrictions, or operational issues. If we cancel an order after payment is captured, an appropriate refund will be issued.

3. Pricing, Taxes, and Payment

Prices may change before an order is placed. Applicable taxes, shipping, discounts, and other charges are shown where required. Payments may be processed by third-party payment providers subject to their terms.

4. Retail and Wholesale Pricing

Publicly displayed prices are retail prices unless otherwise stated. Approved wholesale customers may receive different pricing when signed in. Wholesale access is subject to approval, eligibility, product-specific pricing, and applicable minimum-order requirements.

5. Custom Production

For custom hats, apparel, patches, DTF, stickers, keychains, or other made-to-order work, you are responsible for reviewing and approving artwork, spelling, placement, colors, sizes, quantities, and other specifications. Once production begins, changes or cancellation may not be possible.

6. Customer Artwork and Intellectual Property

You represent that you own or have permission to use any logos, artwork, images, text, trademarks, or other materials you submit. You grant Mad Monkey a limited license to host, copy, process, modify, and use submitted materials as reasonably necessary to quote, proof, manufacture, fulfill, support, or document the requested work.

7. Shipping and Delivery

Delivery dates are estimates unless expressly guaranteed in writing. Carrier delays, weather, incorrect addresses, customs, and events outside our reasonable control may affect delivery.

8. Returns, Refunds, and Exchanges

Returns, exchanges, damaged-item claims, and refunds are governed by our Refund & Return Policy.

9. Promotions and Discount Codes

Promotions may have expiration dates, eligibility rules, product exclusions, minimums, and usage limits. Promotions may not be combined unless expressly stated.

10. TikTok Shop and Other Sales Channels

Mad Monkey products may also be offered through third-party sales channels such as TikTok Shop. Purchases made through a third-party marketplace may also be subject to that marketplace’s terms, payment rules, refund procedures, and platform policies. Where an order is fulfilled by Mad Monkey, our product and production policies continue to apply to the extent permitted by the platform.

11. Acceptable Use

You may not use our services for unlawful, fraudulent, infringing, abusive, or malicious activity; attempt to compromise our systems; or submit content that violates applicable law or third-party rights.

12. Disclaimers

To the maximum extent permitted by law, services are provided on an “as available” basis. We do not guarantee uninterrupted operation or that every error can be prevented. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Mr. Buff Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the services.

14. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, except where consumer law requires otherwise.

15. Changes

We may update these Terms from time to time. The effective date above identifies the current version.
